Three planning commissioners will not resign

Two more members of the Goochland County Planning Commission have decided not to honor the request of the Board of Supervisors and resign.

In a letter sent via email and regular mail Feb. 3, 2012, to County Administrator Rebecca T. Dickson, Planning Commission Chair Courtney Hyers from District 5 and James P. Atkinson from District 1, joined Ty Querry from District 2, who said last week he would not resign, in announcing their decisions.

The letter said that “the Board’s request for resignations of planning commissioners in mid-term implicates state law governing planning commissions. Virginia law requires all jurisdictions in Virginia to establish planning commissions to serve as advisory bodies on land use matters. 

“State law requires that planning commissioners be appointed to specific terms of office and provides that they may not be removed except for just cause. In Goochland County, commission members are appointed to two-year terms, and may serve for a maximum of four terms.”

In a letter from the Board of Supervisors to the commission members Jan. 23, 2012, the resignation of each member was requested by Feb. 3, 2012. One reason given for the request was to reduce the number of members on the commission from 10 to five.

The letter from Hyers, Atkinson and Querry also said that “The Board has the right to replace planning commission members in an orderly fashion, as staggered terms expire, according to law.”

Atkinson, Hyers and Querry’s terms all expire in March 2013.

Five members have resigned. They are Tommy Carter and Derek Murray, District 3; Joe Andrews and James D. Crews Jr., District 4; and Lowe Lunsford III, District 5.
James Melton of District 2 could not be reached concerning his decision, but his term expires in April of this year. Eugene Bryce from District 1, whose term expires in March 2013, declined to comment when reached by phone Monday.

Some people with a WHOLE lotta money are trying to take this county over . Be scared Goochland . Look at the names , And Im not just talking about this thread . Some people are apparently wanting payback for thier support . Eugene if you are the same Eugene who i went to school with , I truely hope you do not resign . We have no diversity in our government right now . The board can make thier changes they just have to wait till its thier turn to make that decision . The law and terms were set for a reason and we should abide by the law .

Say it aint so.  Those must be pretty cushy positions if we want to keep them against the desire of our current leaders.  The Board asked nicely and with good reason and all should comply.  Reminds me of some others who said… you want me to resign?..... well I will need compensation and then I will go AND the last board gave our tax dollars to those who did not deserve it!!!!

Thank you, Letitia, for your reasoned answer.  This is not an issue of personality clashes, disagreements with individual planning commissioners, or conflicts in a sandbox.  Rather, it is about restructuring the process of our county governance.  The voters of Goochland have decided, overwhelmingly, that they want things done differently.  To that end, they made an 80% change in the BOS.  That is a mandate.  The BOS’s judgment that a 5 person PC will work better than a 10 person PC should be respected, even if one does not agree.

Anyone with an ounce of sense can see that this isn’t just about multi-family housing or disagreements between the BOS and PC.  That is the kind of one-dimensional, insipid thinking that has gotten our county into the mess it’s in. Asking the PC members to step down (perhaps even temporarily) in order to constructively restructure is quite logical (albeit astonishing to those with substandard IQs).

Have you ever been to a PC meeting (or listened to the recordings)?  There is often disconnect, confusion, and disinformation (the Jan. 19th meeting was a prime example).  It has been clear for some time that a 10-person PC is way too large and it has suffered from inefficiency and ineffectiveness. 

Truly, it is incredible that the three PC members who are refusing to step down actually think that they are so very much more important and crucial than the other seven (who did the right thing by respectfully resigning).

Golly, Tom , Still not quite understanding where someone got sand thrown in their eyes in thsi sandbox. To the best of my knowledge Pand Z has only met once since we have had a new board and they set up teh public hearing on Multi Family housing for Feb 8th. (Only heaven knwos how that will happen now )
So what decision did the new BOS make that P and Z didn’t support ?

An Occupy the Planning Commission Movement is afoot.  They pitched their tents and are not going away.
JoD, it is not that they disagree, but that they refuse to respect the decisions with which they disagree.  They refuse to respect the decision of the citizens that elected this BOS to change the structure of our county government.

I thought the BOS was looking for autonomy by having a whole new board but now I see . Its just that because they don’t agree with the new BOS they will be ignored.

JoD, the Planning Commission’s job is to assist the BOS by providing advice.  The advice from the PC members that have chosen to be confrontational, rather than cooperative has been rendered completely useless.  Their votes on multifamily housing, or whatever, are completely meaningless, and will be ignored.  The BOS members’ work load will now be increased.  How can the advice of these people that have decided to impede the BOS be of any value?

So 5 members resigned. And two have terms ending in 2 months. Three want to stay. The three that want to stay are in three different districts.So now the BOS potientially has their 5 person board all they have to do is pick a representative for four and three.
What’s the deal here?
What happened to the new Board of Supervisors who are going to play nicely in the sandbox with everyone ? They only want to play with the people who they pick ? How does that make sense ? That’s not a playing nicely that’s drawing sides.
What is it that the old commision is voting on that the new Board of Supervisors is concerned that they won’t do ? Oh wait could it be MULTI FAMILY HOUSING?
